Know your rights when you’re arrested

  • Don't speak to anyone.
  • You have the right to remain silent.
  • Immediately consult an attorney

Don’t open your mouth if you’re unsure of how it will affect you. Be cautious. Miranda Rights exist for your protection. Much of what you do and say early on dictates how much legal representation and rights you have throughout your trial. You waive Miranda Rights when you inform the arresting officers that you wish to speak on your own behalf. However, to invoke Miranda Rights affords you the right to speak only to an attorney, and to remain silent until an attorney is present. It is important to remain silent especially if you're unsure how your words might incriminate you.

Arrest Procedures

  • You are served with a complaint.
  • Your fingerprints and photos are taken.
  • Bail is set.

The sooner you have an attorney, the better your chances are of having options in court. Aside from your initial Miranda Rights, having an attorney affords you other rights that you might be unaware of. A good lawyer will help you to navigate the complex New Jersey Legal System. Your lawyer will be instrumental in getting you the best result in court. In some cases, an attorney must be present to speak on your behalf and to earn you the rights and privileges you deserve under the law. Without an attorney, you're left to your own devices, and that is just what the prosecution looks for. In summation, acquiring a good lawyer, having a basic knowledge of your Miranda rights, and being aware of which rights pertain to your case really does make the difference.
